Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to potential chemical burns to the lungs from the release of anhydrous ammonia: (a)On or about July 2, 2003, at Pro Foods International, LLC, employees were exposed to releases of anhydrous ammonia which was used as a refrigerant in the fry line. Ammonia releases might occur as a result of, but not limited to, the following: 1.In the ammonia compressor room, the doors connecting to the fry line area, and to the adjacent electrical room were not self closing type. 2.Remote control of the mechanical equipment was not provided immediately outside the compressor room door, nor was a control switch provided for the ventilation in that room. 3.Pipes, valves, switches involved with the refrigerant (ammonia) were not labeled and identified. 4.Self-Contained Breathing Apparatus (SCBA) respirators were not provided outside the compressor room. 5.An alarm set at a value not greater than the OSHA PEL (50 ppm) and a detector for ammonia leaks were not provided in the compressor room. 6.Signs reading Authorized Personnel Only were not posted on doors of the compressor room. 7.Schematic drawings or panels giving directions for the operation of the refrigeration system were not provided. 8.Legible permanent signs indicating the name and address of the refrigerating system installer, number and amount of refrigerant, lubricant identity and amount, and field test pressure applied were not provided in the compressor room. 9.Emergency shutdown procedures were not displayed in the ammonia compressor room. 10.Equipment and floor were oily and dirty in the compressor room. Among other methods, one feasible and acceptable method to correct the hazards are: 1.Adherence to the safe design, installation, and operation of ammonia refrigeration systems as prescribed by the ANSI/ASHRAE 15-2001 (Safety Standard for Refrigeration Systems).tion
