North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards: a)jobsite, South Main Street, Troutman, NC - an employee used the bucket of a backhoe loader as a work platform to hang flags approximately 8 feet above the ground. Ref: Equipment Manufacturers Institute Safety Manual for operators and mechanics Backhoe/Loader Page 22, REMEMBER THE OTHER PERSON (continued) "Never use a bucket for a work platform or personnel carrier." Note: Among other methods, one feasible and acceptable means of abatement to correct this hazard is to prohibit employees from using a bucket as a work platform.
