Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to: Being thrown from a rough terrain forklift truck and/or struck by the rough terrain forklift truck. (a)Entire Exterior Jobsite - Employees were not protected from the hazard of being thrown from and/or being struck-by a rough terrain forklift truck. Employees operate a Pettibone Model 6-33, Rough Terrain Forklift Truck, Serial Number 6-2724 that had the factory installed seat belt and horn removed. Among others, one feasible and useful abatement method to correct the hazard is to: Replace the removed seat belt and horn.
