Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to: Being thrown from a rough terrain forklift truck and/or struck by the rough terrain forklift truck. (a)Entire Exterior Jobsite - Employees were not protected from the hazard of being thrown from and/or being struck-by a rough terrain forklift truck. An employees was operating a Matboro Hi-Torque Model TS 270, Rough Terrain Forklift Truck and was not using the factory installed seat belt. Among others, one feasible and useful abatement method to correct the hazard is to: Ensure that employees that operate Hi-Torque Model TS 270, Rough Terrain forklift operate and use seat belt.
