Section 6(a) of the Puerto Rico Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or physical harm to employees in that employees were exposed to: Seccion 6(a) de la Ley de Seguridad y Salud en el Trabajo de Puerto Rico: El patrono no proveyo empleo y un sitio de empleo libre de riesgos reconocidos que esten causando o que puedan causar muerte o dano fisico a los empleados, por cuanto empleados estaban expuestos a: a. Receive injuries due to emplyee fall from power shovel. The employee was using the power shovel of a digger trademark Caterpilar, Model 416B as walking/working surface at 7 feet high approximately above lower level. The employee was filling a column at the northeast of the construcction site. Among other methods, one feasible and acceptable abatement method to correct this hazard is to provide a safe walking/working surface with standard guard rails or personal fall arrest system. a. Recibir lesiones debido a caida de empleado de pala mecanica. El empleado estaba usando la pala mecanica de excavadora marca Caterpilar, modelo 416B como superficie de transito/trabajo a 7 pies de alto aproximadamente sobre el nivel mas bajo. El empleado estaba llenando una columna en el lado noreste en el sitio en construccion. Entre otros metodos, un metodo aceptable y posible de corregir este riesgo es proveer una superficie de transito/trabajo segura con barandas regulares o sistema personal de detencion de caidas.
