Section 6(a) of the Puerto Rico Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or physical harm to employees in that employees were exposed to: Seccion 6(a) de la Ley de Seguridad y Salud en el Trabajo de Puerto Rico: El patrono no proveyo empleo y un sitio de empleo libre de riesgos reconocidos que esten causando o que puedan causar muerte o dano fisico a los empleados, por cuanto empleados estaban expuestos a: a. Receive serious injuries or dead due to that an employee working under forklift trademark Nissan, model WGF03H40V, type-D without being secured for falls. The employee was working with emergency brake system in front of warehouse. Among other methods, one feasible and acceptable abatement method to correct this hazard is lift the forklift for repair or inspecction in a safe, secure, and stable manner as recomended by ASME/ANSI B56.1-1988, Sec. 6.2.1. a. Recibir serias lesiones o muerte debido a que un empleado trabajaba debajo de montacarga marca Nissan, modelo WGF03H40V, tipo-D sin asegurarlo contra caida. El empledo estaba trabajando con el sistema de frenos de emergencia frente al almacen. Entre otros metodos, un metodo aceptable y posible de corregir este riesgo es levantar el montacarga para reparacion o inspeccion en forma segura, asegurada, y de manera estable segun recomendado por ASME/ANSI B56.1-1988, Seccion 6.2.1.
