Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to falls from ladders:
a) On or about 6/4/03, employees working in the Back Room were required to
use
a portable metal ladder to access boxes of merchandise stored on upper
level shelves.
The employees then descended the ladder while carrying the boxes of
merchandise.
Employees did not have at least one hand free in order to maintain a firm
hold on
the ladder while descending.  American National Standards Institute
standard
A14.2-2000 Section 8.3.7 requires that when ascending or descending the
ladder, the
user shall face the ladder and maintain a firm hold on the ladder.
Note:  Among other feasible and acceptable abatement methods would be 1)
provide
employees with a rolling staircase to be used to access boxes of
merchandise on
upper shelves.
