Section 88.4 - Code of Iowa (2003) 88.4: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to hazards associated with confined space entry: (a)Storage Tank - There was no confined space survey, hazard identification & evaluation, written program, training or atmospheric testing to ensure safe entry into confined spaces. This resulted in a fatality on 7/18/03 where an employee suffocated due to the lack of oxygen. Among other methods, one feasible and acceptable abatement method to correct this hazard is to implement a confined space program including survey of spaces, hazard identification and evaluation, a written program, training and atmospheric testing as described in ANSI Z117.1- 1995 safety requirements for confined spaces.d
