employer did not
furnish employmnent and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
On June 6th, 2003, and at times prior thereto, the company did not follow
the manufacturer's
safe operating procedures as set forth in the operator's handbook for the
Hydraulic Slide
Coupler, in that, the equipment was not powered down and the supplemental
lock engaged after
each bucket change thereby exposing employees to a struck-by hazard.
Among other methods, feasible and acceptable abatement methods to correct
this include, but
are not limited to the following:
1. Follow manufacturers requirement to install supplemental lock when
attaching bucket.
2. Prevent employees from walking or working in the excavation when the
excavator is being
used with the quick disconnect coupler.
3. The employer shall train all operators to conduct daily safety
inspections of their equipment
to ensure that the hydraulic coupler (supplemental lock) is in place
before operation and to
recognize if the supplemental lock is defective and/or missing.
