Section 5(a)(1) of the Occupational Safety and Health Act: The employer did not furnish to employees places and conditions of employment that were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being caught by the auger machine which was not equipped with the required emergency shut-down switch. (a)The 8 x 8 portable and limited access drilling rig was not equipped with an emergency shut-down switch. All safety devices, such as emergency shut-down switches, should be checked and tested, at least daily and preferably at the start of a drilling shift. Drilling must not be permitted until all emergency shut-down and warning systems are working correctly and do not allow any emergency device to be bypassed or removed. These practices are specified in the National Drilling Association Drilling Safety Guide, Chapter 3.

Section 5(a)(1) of the Occupational Safety and Health Act: The employer did not furnish to employees places and conditions of employment that were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being caught by over length pins or bolts used to secure the auger to the power coupling. (a)On the drilling rig, an allen wrench was used to connect the auger to the power coupling. The allen wrench protruded about 2 inches from the power coupling, exposing employees to the hazard of being caught by the allen wrench when the auger rotated. Among other methods, one feasible and acceptable method to correct this hazard was not to use over length pins or bolts to secure the auger to the power coupling. This practice is specified in the National Drilling Association Drilling Safety Guide, Chapter 16.
