Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not provide a place of employment that was free from recognized hazards that were likely to cause death or serious physical harm to employees in that employees were exposed to being struck by falling stone due to potential failure of a stone lifting device which was attached to a boom lifted by a forklift. A clamp was used to lift the stone approximately 1350 lbs. The clamp was not tested nor rated for the use it was intended. Among feasible methods to abate this condition is to: Comply with the American National Standards Institute (ANSI) Safety Standard for Below thge Hook Lifting Devices, ANSI B30.20-1993, Section 1.2.- Marking and Construction and Section 1.4 -Testing.
