Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
a place of employment which was free from recognized hazards that were
likely to cause death
or serious physical harm to employees, in that employees were using
damaged chairs while
performing their work and subject to falling/sliding from the chairs.
Packaging, matching and batching, and keying areas - chairs with loose
backs and chairs with
seat pans that dropped suddenly with the weight of the employee were being
used by employees
while performing their work. On or about July 2, 2003, there was a report
of an employee
falling from a chair and sustaining an injury.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is
to purchase an adequate number of new chairs. Damaged chairs that have
been moved to the
warehouse should be tagged with a "Do not use" sign.
