Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish
a place of employment which was free from recognized hazards that were
causing or likely to
cause death or serious physical harm to employees. Employees were exposed
to being  struck
by a falling residential balloon wall during chimney chase erection. The
wall and chase were
constructed as one piece.
By The Chase Wall Area of the House - On or about 9-8-03, employees were
pushing
the balloon wall approximately 3000 lbs into place manually instead of
using a mechanical lifting
device.
Feasible means of abatement includes but is not limited to the use of a
crane.
