General-duty citation text
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish a place of employment which was free from recognized hazards that were likely to cause death or serious physical harm to employees in that employees were not protected from automatic restart of metal-cutting saws: The reconditioned vertical bandsaw, shop area, did not have a provision to prevent automatic start-up in the event of a power outage (e.g. magnetic motor restart). ANSI B11.10-1990, Section 4.2.3.4 states that in the event of an interruption in the electrical power supply, the machine shall not restart automatically when power is restored. Reconditioned vertical bandsaw of unknown make was equipped with a toggle-type start switch which did not provide protection for employees in the event of a power outage and subsequent unexpected start-up after restoration of power.
