Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to a collapse:
Tropicana Garage: Site Blauvelt inspectors did not perform all work in a
manner
consistent with standards of their profession;
a)Employer did not provide employees with the education and training to
properly
perform the inspections appropriate for the work being performed, on or
about
10/30/03.
b)Approval of rebar placement was given even though the welded wire fabric
"mesh" was not embedded into the columns and shear wall along column line
1,
to develop its full strength and to reinforce the exterior beam to column
and shear
wall connections, welded wire fabric "mesh" was not properly placed into
the
shear wall at a uniform depth to develop its full flexural strength,and
one or more
top longitudinal reinforcing bars of the exterior beam along column line 1
were
not placed through the column to reinforce the beam connection, on or about
10/30/03.
ABATEMENT NOTE: Feasible and acceptable methods for abating this hazard
are:
1)Refer to ACI 318-95  Building Code Requirements for Concrete and
Commentary
requirements.
2)Refer to ACI Detailing Manual - Recommended Practices for Location of
Bars
Designated Only By Size/Spacing which describes the standard spacing for
reinforcing bars when the spacing is not provided on the detailed drawing.
3)Follow the BOCA National Building Code/1996
4)Follow shop drawings and/or structural drawings and refer any
discrepancies to
the Construction Manager.
5)Follow CRSI publication #49 and Manual for Placing Reinforcing Bars.
6)Follow ASTM E329
NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS
REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE
TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 AS PER 29
CFR 1903.19.
