Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being crushed by a forklift in the event of a rollover: a- Distribution Area - The employer failed to require employees operating forklifts to wear restraint devices when exposed to a tipping hazard. Condition noted on or about 7/9/03. Among other means, one feasible and acceptable method to correct this hazard would be for the company to require employees to utilize seat belts during forklift operation and to reinforce this requirement during the employee training program.
