Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a falling hazard and/or crushing hazard: a) Pallet area. Employees driving the Yale propane and Yale diesel forklift trucks were not wearing seat belts, where the forklift truck was equipped with such safety devices. Condition observed on or about 7/30/03. One feasible and acceptable method to correct the hazard is to enforce the use of seat belts during forklift truck operations.
