Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being infected with Mycobacterium tuberculosis through unprotected contact with sputum cultures that were infectious or suspected to be infectious with tuberculosis during the loading and unloading of medical waste from the grinder: a) Grinder/Compactor Area: Employees were exposed to sputum cultures that were infectious or suspected to be infectious with tuberculosis during the loading and unloading of medical waste from the grinder and compactor. Employees were not provided an annual PPD skin test or a chest radiogram/x-ray to evaluate their tuberculosis exposure.Condition occurred on or about October 22, 2003 and again on or about December 26, 2003. Feasible and useful abatement methods for reducing this hazard, as recommended by the CDC, include, but are not limited to: a) Make available Purified Protein Derivative (PPD) skin tests (at no cost to the employees) to all current potentially exposed employees and to all new employees prior to exposure. A two-step baseline shall be used for new employees who have not had a documented negative TB skin test result during the preceding 12 months. b) Follow-up and treatment evaluations are also to be offered at no cost to the employees. TB testing shall be conducted annually for at-risk personnel. If the initial chest radiograph (for the positive PPD tested employee) is negative, repeated chest radiographs are not necessary unless symptoms develop that can be attributed to TB. c) Implement case management of possible infected employees from a positive PPD skin test. Further evaluation shall include as soon as possible: appropriate physical, laboratory, and radiographic tests to determine whether the employee has infectious TB disease. d) Worker education, training and implementation of controls shall be set up. e) Maintain documentation and appropriate paperwork.
