Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazards of operating defective equipment:
a- Sayreville Site - Yard:
1- Loader #966F - The transmission and gas gauges on the dashboard were not
in operating condition.
2- Pot Truck #L016 was not completely repaired before being placed back
into
service.
3- Pot Truck #L014 was leaking oil during this inspection.
4- Excavator #235 - The magnet was alleged to arc during operations.
Employees (specifically partially English speaking) are not adequately
trained to identify
hazard(s) and/or defects of their trucks.  Employees are not adequately
trained to report
hazard(s) or defect(s) timely.  Defects that are reported are not always
corrected
within
a reasonable time, e.g., request for repairs during the early part of May
are still pending
the lateral part of June.
Observed 6/18/04.
Abatement Method:  Feasible and acceptable abatement methods, not limited
to:
1- Repair all trucks with defects as timely as possible.
2- Continue to tag trucks out of service and allow them to remain out of
services
until restored to proper operating condition.
3- Adequately train employees to recognize their truck's defects and to
report
them on a timely basis.
