Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish to each of his employees employment and a place of employment
which were free
from recognized hazards that were causing or likely to cause death or
serious physical harm
to employees in that employees were exposed to potential hazards by
operating equipment
without being properly trained in the safe operation and maintenance of
such equipment.
a)2 Cosco Way, Monroe, NJ 08831. The employer allowed his employee to
operate
and install precast concrete panels by using a JLG as a crane to lift and
set the
supporting shore braces. The operator was never trained by a qualified
person in
understanding the safety, operating and maintenance of the JLG used for
this project.
ABATEMENT NOTE: AMONG OTHER MEANS, ONE FEASIBLE AND
ACCEPTABLE METHOD TO CORRECT THIS HAZARD IS TO:
1) PROPERLY TRAIN EMPLOYEES AS DESCRIBED IN THE JLG
OPERATIONS AND SAFETY MANUAL BY A QUALIFIED PERSON AND
AUTHORIZED TO OPERATE THIS PIECE OF EQUIPMENT. TRAINING
SHOULD INCLUDE READING AND UNDERSTANDING THE SAFETY,
OPERATING AND MAINTENANCE IN THE MANUFACTURES MANUAL,
KNOWING YOUR EMPLOYERS WORK RULES AND APPLICABLE
GOVERNMENTAL REGULATIONS. THE OPERATIONS AND SAFETY
MANUAL CLEARLY INDICATES THAT THIS JLG SHOULD NOT BE USED AS
A CRANE.

between and or crushed
by not using this equipment as recommended by the manufacturer.

to use
the JLG in this fashion.
