Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to struck-by hazards:
a)On or about August 19, 2003, traffic control devices were not in place
to provide
adequate advance notice to an on-coming motorist of an employee work zone
where two lawn & landscape workers were standing at the back of their work
truck that was parked on the outside traffic lane of a multilane divided
private
street within a gated community.  The motorist fatally struck one worker
when
he drove into the back of the parked work truck.
b)On or about September 11, 2003, the two traffic cones that were placed
on the
grass behind the work truck did not provide adequate advance notice to on-
coming motorists of an employee work zone at the intersection of A1A and
Camino del Rey, a private road, where three lawn & landscape workers
trimmed
shrubs and ornamental grass while standing or walking on the road pavement
of
A1A or Camino del Rey.
Among other methods, one feasible and acceptable abatement method to
correct
this hazard is to follow the American National Standard Z133.1 for
Arboricultural
Operations - Pruning, Repairing, Maintaining, and Removing Trees, and
Cutting
Brush - Safety Requirements, which states that effective means for
controlling
pedestrian and vehicular traffic shall be instituted on every job site
where
necessary in accordance with the U.S. Department of Transportation Manual
on
Uniform Traffic Control Devices.
