Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the aerial lift collapsing and creating a crushing hazard: a.On or about March 17, 2004, two employees were using an aerial lift as a crane to lift, steady, and move a metal pole that supported a neon sign, exposing employees to the hazard of the aerial lift collapsing and crushing them. Among other methods, one feasible and acceptable abatement method to correct this hazard is to follow the manufacturer's operator manual to not use the aerial lift as a crane, and by obtaining an actual crane for any lifting operations. ABATEMENT CERTIFICATION IS NOT REQUIRED.TION
