Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing or struck-by hazards when operating powered industrial trucks: a.On or about July 21, 2004, the employer did not require a forklift operator to wear the installed seat belt to restrain and protect the operator in the case of a tipover of the forklift. Among other methods, one feasible and acceptable method to correct this hazard is to enforce the use of seatbelts while operating forklifts. ABATEMENT CERTIFICATION IS NOT REQUIRED.TION
