Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to being struck by equipment or materials:
a.On or about August 11, 2004, employees engaged in concrete work were
exposed
to being struck by the boom associated with the sudden drop of an overhead
boom
because dunnage was not placed under the outriggers of the concrete pump
truck.
Employees were exposed to the hazard of being stuck by the boom, when an
outrigger broke through the road asphalt surface.
Among other methods, one feasible and acceptable abatement method to
correct
this hazard is to follow the manufacturer's operating instructions when
operating
concrete pumper, which includes setting of the support legs on two layers
of
crosswise positioned boards, and to be aware that asphalt may have been
washed
out underneath.
