Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards of ten feet: (a) Macedonia Baptist Church jobsite, (Duquesne, PA); On or about June 26, 2003, an employee was standing on a wooden pallet attached to the forks of a Lull was not protected from falling. The employee was approximately ten feet above the ground and was supplying materials to bricklayers who were working on a scaffold. Among other methods, a feasible and acceptable method to correct this hazard is to provide a safety platform for use with the Lull.
