Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by the unguarded rotating superstructure and counterweight of the John Deere excavator, or by the John Deere excavator itself if it slid into the excavation due to its positioning on unstable ground. One feasible and acceptable method, among others, to abate the hazards is to follow the excavator manufacturer's (John Deere Manufacturing) safety requirements as listed in the "Operator's Manual for 992E LC Excavator", "Section 05-1, Safety" and "Section 06-35, Operating the Machine" and the industry safety requirements found in the Construction Industry Manufacturer's Association (CIMA) Publication " Safety Manual For Users, Operators and Maintenance Personnel - Hydraulic Excavator" by: 1.Training employees on the hazards of the rotating superstructure/counterweights and placing barriers around the swing radius of the rotating superstructure. 2.Ensuring that the excavator is positioned on ground that is stable and strong enough to support the imposed weight of the machine and vibration of the operation without failure.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard in excess of 20 feet while riding in the bucket of the John Deere excavator to get into and out of the excavation. One feasible and acceptable method, among others, to abate the hazard is to not allow riders on the excavator or its attachments, as per the excavator manufacturer's (John Deere Manufacturing) safety requirements listed in the "Operator's Manual for 992E LC Excavator" and the industry safety requirements listed in the Construction Industry Manufacturer's Association (CIMA) Publication "Safety Manual for Users, Operators and Maintenance Personnel - Hydraulic Excavator".
