T.C.A. 50-3-105(1):  The employer did not furnish employment and a place
of employment
which were free from recognized hazards that were causing or likely to
cause death or serious
physical harm to employees in that employees were exposed to:
a. In that the Michigan Clark front end loader was not equipped with a
seatbelt as required to
prevent crushing injuries in the event of a tip over.
b. In that the BobCat front end loader was equipped with a fuel tank that
was not made for such
use to reduce the likelihood of burns and other injuries caused by a fire.
Among other methods, one feasible and acceptable abatement method to
correct the hazard
associated with item (a) of this citation would be to install a seatbelt
on the Michigan Clark front
end loader.
Among other methods, one feasible and acceptable abatement method to
correct the hazard
associated with item (b) of this citation would be to remove the improper
fuel
tank and repair
or install a new permanent fuel tank approved by the manufacturer.
