T.C.A. 50-3-105(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: In that the following forklifts with overhead guards lacked seat belts to prevent employees from being exposed to crushing injuries in the event of a tip-over: a) Baker b) Mitsubishi *One method of abatement is to install seat belts and to implement an enforcement policy for seat belt use.
