Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
(a)On May 21, 2004, an employee was exposed to the hazard of being struck
by lightning
while working outdoors under lightning and thunderstorm conditions.  Among
methods,
one feasible and acceptable abatement method to correct this hazard is the
implementation
of an effective safety program which could include the following
essentials:
1)Develop and implement an effective written lightning protection system.
2)Follow the Federal Emergency Management Agency; National Oceanic &
Atmospheric Administration; National Weather Channel; Lightning Protection
Institute; and the local Weather Channel.  "Lightning & Safety Guidelines"
to be
followed as a thunderstorm approaches.
3)Provide training to educate the managers on lightning safety guidelines.
4)Implement an effective enforcement procedure.
5)Remove employees from the site after recognizing incoming lightning
and/or
thunderstorm.
