Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard and an employee outside the designated operator's position while lowering the arm: Elevated work platforms used with Rough Terrain Forklift Trucks as designated by the manufacturer must meet design, construction, and use requirements as outlined by ASME B56.6 Safety Standards for Rough Terrain Forklift Trucks Section 5.15.1 (k): requiring restraining means such as railings, chains, cables, harness(s) with lanyard(s) were not in place or properly used. Also in ASME B56.6-2002 Section 6.2.2: Employees started or operated the rough terrain forklift truck, any of its functions or attachments, from a place other than from the designated operator's position. (a)On July 27, 2004, an employee of Houlihan Construction, Inc. worked on an elevated platform extended by a Cat Th63, all-terrain lift which did not meet the design and use requirements of ASME B56.6 Section 5.15.1 (k) in the following area: 1) The guardrail around the upper periphery was incomplete. (b)On July 27, 2004, an employee of Houlihan Construction, Inc. was lowering the arm of the rough terrain forklift from the outside of the machine. Among other methods, feasible and acceptable means to correct these hazards are to use a safer alternate method such as the use of a platform approved by the manufacture meeting the requirements of ASME/ANSI B56.6-2002 for the attachments on rough terrain lifts and ensure the operator is in the correct position while operating the rough terrain forklift.
