Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employmnent and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to: lack of prompt medical treatment for chemical burns to
hands, feet and
chemical splashes to eyes.
a) On or about September 14, 2004, a worker got wheel cleaner (phosphoric
acid) in his eye.
The employer was made aware of the problem, but prompt medical attention
was not provided.
Several hours later, toward the end of the shift the worker drove to the
hospital emergency room
where for treatment.
b) On or about September 24, 2004, a different worker got chemical burns
(Lustre Glaze
containing Toluene) on his foot and both hands. The employer was made
aware of the problem
but prompt medical attention was not provided.
Among other methods, feasible and acceptable means to correct these
hazards are to have trained
first aid responders and or an agreement with the local hospital to treat
workers promptly.
Workers must be allowed to get prompt assistance for medical treatment
when hurt or injured.
Abatement Certification and Abatement Documentation required.
