Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a crushing hazard when employees are riding on the side or in the bucket of a payloader: The employer did not comply with the owners manual for the John Deer 624 Wheel Loader; page 05-12: Only allow the operator on the machine. Keep riders off. Riders are subject to injury by being thrown off the machine. Riders also obstruct the operators view resulting in the machine being operated in an unsafe manner. (a) On October 20, 2004, an employee was riding in the bucket of a John Deer 624H paylaoder. (b) On October 20, 2004, an employee was observed twice riding on the ladder (steps) of a John Deer 624 Payloader. No Abatement Certification or Abatement Documentation required.tion
