Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to multiple injuries/death when the lift truck used was exposed to vehicle traffic: a) On March 03, 2005, employees engaged in sign maintenance were exposed to struck- by hazards from motor traffic while working from an aerial lift that was elevated approximately 15 feet above ground level. The aerial lift was used on the traveled portions of a busy driveway into a parking lot from Webster Ave. in Green Bay, Wisconsin without any form of protection from traffic. Among other feasible and acceptable abatement methods to correct this hazard include the proper placement of advance warning signage and channelizing devices. These abatement methods are discussed in detail in Part VI, Chapter G of the Manual on Uniform Traffic Control Devices (MUTCD 2000) Millennium Edition, No Abatement Certification or Abatement Documentation required.
