Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to multiple injuries or death from tip over and improper use
of a basket on a
rough terrain forklift.
The rough terrain forklift was not used in accordance with the American
National Standard
Institute ASME/ANSI B56.6-2002: Safety Standards for Rough Terrain
Forklift: Section 5.15.1;
Elevating Personnel, Paragraph s; A trained operator shall be in position
to control the rough
terrain forklift. When the operator is not in the operating position, the
truck wheels were not
blocked and the parking brake with all travel controls in neutral. Section
8.24; Platforms for
Elevating Personnel, paragraph b; The overall width of a platform was
greater than the overall
width of the truck [measured across the load bearing tires plus 10 inches
on
either side].
(a) On June 29, 2005, an employee was exposed to a tip over hazard when
working in a
personnel basket attached to a rough terrain forklift without the operator
at the controls and the
rough terrains wheels were not blocked on a 30grade.
(b) An employee was working in a 10 foot long personnel basket suspended
on a rough terrain
forklift that had a wheel base 6 feet wide.
Among other methods, feasible acceptable means to correct the hazards
would be to use rough
terrain forklifts in accordance with ANSI B56.6.
