Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to death or serious injuries from falls or forklift tip over. (a) On March 2, 2006, two employees of Bohlman Construction were exposed to over a 10 foot fall hazard when transported approximately 100 yards on a rough terrain forklift personnel platform that was missing guard rails to the front of the platform nor was any other form of fall protection used. (b) Employees were exposed to a tip over hazard when riding and working on a suspended rough terrain forklift platform where the length exceeded the manufacturers/ANSI design specifications. The wheel base was 8 feet wide and the suspended platform was 14 feet wide. Among other methods, feasible and acceptable means to correct the hazards are to use a safer alternate method such as the use of a platform designed and approved by the manufacture meeting the requirements of the "American National Standards Institute", ASME/ANSI B56.6- 2002, Safety standards for Rough Terrain Forklift Trucks; section 5.15.1(k), "be certain that required straining means such as railings, chains, cables, harness(s) with lanyard(s), etc., are in place and properly used", section 5.15.1(q), "always lower the platform if you must move the rough terrain forklift truck for adjustment in positioning" and section 8.24.1(b), "floor dimensions shall not exceed two times the load center distance listed on the rough terrain forklift truck nameplate nor have a width greater than the overall width of the truck [measured across the load bearing tires plus 10 inches on either side]". Bohlman Construction was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard 5a1 which was contained in OSHA Inspection Number 306796889, Citation Number, 1 Item Number 1, issued on 08/20/2004, with respect to a workplace located at 910 State Street, Sturgeon Bay, Wi. 54235.
