Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employmnent and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to a fall hazard:
(a)  At the site, two employees were allowed to stand, work, and climb on
the midrail/top rail
of the elevated work platform of the lift approximately 26 feet above
ground level.
One feasible method of abatement, among others, would be to comply with the
manufacturer's instructions and the Self-Propelled Elevating Work
Platform, ANSI/SIA
Standard A92.6-1999: section 7.10(9), "Personnel shall maintain a firm
footing on the
platform floor while working thereon. Climbing by occupants on the midrail
or top rail
of the self-propelled elevating platform is prohibited". Section 7.6,
"Whenever a user
directs or authorizes an individual to operate an aerial platform the user
shall
ensure the
person has been trained before being assigned to operate the aerial
platform and made
aware of responsibilities of operators as outlined in Section 8 of this
standard".
