Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to the hazards associated with being struck by and
or crushed by a
crane tipping and overturning:
Jobsite:  Northbound side of Lee Burbank Highway, between the area of
Tanks #21 and #23:
ON June 26, 2003, the Deutsche Grove 150 ton capacity truck crane was set
up on its four outriggers fully extended with no cribbing and with the boom
fully extended over the left rear from the operator's cab with no load on
the
hook.  The crane overturned when its left rear outrigger pad sank into the
ground, fatally injuring the crane operator, and exposing employees to the
reisk of being struck by the crane.  The employer did not communicate with
the crane company or the operator concerning the ground conditions.
One feasible method of abatement, among others, would be to prohibit any
crane
operator
from coming onto a worksite on the Inspection Site until said crane
operator has conducted a
site and ground condition assessment at the worksite and determines to
his/her satisfaction,
consistent with recognized industry practices, that the crane can be
safely operated at the
worksite consistent with manufacturers' specifications.
