Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards associated with crushing injuries due to fork truck tipover when not wearing a seatbelt. while traveling on a ramp or dock: Loading Dock: Employees were not wearing seatbelts while operating fork trucks on the ramp to the loading dock and on the loading dock itself. One method of abatement is to retrain all operators and enforce the wearing of seatbelts. Another method of abatement is to inspect the seatbelts regularly.
