Section 5(a)(1) of the occupational safety and health act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards while working from a safety platform, without fall protection, and elevated by a forklift truck. Establishment: The safety platform used by employees when elevated by the Toyota forklift truck was not equipped with standard railings on the open side. One method, among other methods, to correct the condition is to install chains across the to protect the employee from the fall hazards.
