Section 5 (a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, employees were operating forklift trucks without wearing the seat belt exposing them to potential crushing injuries. Lumber yard: The Nissan #7 forklift truck (Model WGF03A40V) was missing the seatbelt on the right side of the truck exposing employees to potential crushing hazards. One feasible and acceptable method of abatement is to have the manufacturer or their representative reinstall the missing seatbelt. Also, the employer could modify the daily inspection of forklifts to include a seatbelt check so that missing or damaged seatbelts will be reported in a timely manner.
