Section 5(a)(1) of the occupational safety and health act of 1970:  The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that employees were
exposed to being struck by vehicular traffic while working behind a
traffic detour and road
closure.Among other methods, one feasible and acceptable method to correct
the hazard is to
ensure that traffic management plans are followed and that the plans
reference the specific
purpose for the detour to ensure adequate protection for employees in that
work zone.
Location:Ramp ST-CN (Sumner Tunnel to I-93N)
Two employees were seriously injured when a vehicle crashed through a
traffic
detour that:
a)The detour/road closure was not set up according the traffic management
plan
in that: Traffic cones were used in place of Drums, A variable message Sign
(VMS) was not used and Two type III barriers with signage attached were
also
not in place.
b) The traffic management plan was developed specifically for demolition
of the
existing artery and not the installation of drainage grating at the mouth
of the I-
93N tunnel.
