Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall and serious contusions and crushing injuries by riding in the bucket of a crawler excavator to egress an excavation 16 feet deep. Among other methods, one feasible and acceptable abatement method to correct this hazard is to install ladders into the excavation for access and egress. Location: Job site. Employees were exposed to serious injuries while riding in the bucket of a caterpillar 235C excavator to egress the sixteen (16) foot deep excavation they were working in.king
