Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards associated with a vertical material reciprocating conveyor which did not comply with ANSI B20.1 Section 6.21.2: Banbury Room: 1) An interlocked gate did not protect the shaft opening at the second level while the elevator platform was at the first floor. An employee could fall down the shaft. 2) An opening exists below the elevator platform when it ascends to the second floor at the level of the roller table. An employee could fall below the platform and down the shaft. 3) An interlocked gate did not close the elevator shaft opening on the first floor while the elevator platform is descending from the first floor. An employee could get injured by the descending or ascending platform. One method of abate is to install electrically and mechanically interlocked gates at both levels with an additional gate to guard the opening below the lift table when it ascends to the second floor as long as the additional gate itself does not create a hazardous condition.
