Section 5(a)(1) of the Occupational Safety and Health Act of 1970:
The employer did not furnish employment and a place of employment
which was free from recognized hazards that were causing or likely
to cause death or serious physical harm to employees in that
employees were exposed to fall hazards and/or crushing hazards
created by the inclined reciprocating conveyer.
Shipping Department:
1)The platform for the inclined reciprocating conveyer was open
on the front side exposing employees to fall hazards while
loading the conveyer from the second floor.
2)Comprehensive guards on the right and left hand sides with an
electrically interlocked gate on the front were not provided
to protect employees from the crushing hazards on the first
floor.
3)The gate on the second floor could be opened when the car was
not at the landing exposing employees to fall hazards.
Feasible and acceptable methods of abatement include:
1)Install a standard railing on the front side of the platform.
2)Install comprehensive guards on both the right and left hand
side with an electrically interlocked gate on the first floor.
3)Install an electrically and mechanically interlocked gate on
the second floor.
