Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employee(s) were exposed to fall hazards while working from a wooden pallet without fall protection while elevated by a forklift truck. Channel Street - Freezer: An employee was exposed to serious fall hazards while standing on a wooden pallet, without fall protection, that was being elevated by a Raymond Hi-Stacker fork lift truck. One method, among other methods, to correct the condition is to ensure that order picking is only done by the appropriate order picking equipment and that appropriate fall protection is used. Train all employees not to use forklift trucks that are not designed for order picking.
