Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazards associated with electrical shock and or burns
while working within
ten feet of power lines while removing and trimming trees.
Location:  Job site.
1.  The employee was seriously injured when he came into contact with a
7960
volt power line, while preparing to cut a limb from a tree.
2.  The employee did not receive training in the hazards associated with
tree
services, while working around energized conductors.
3.  The employer did not notify the power company prior to the work being
performed in the vicinity of the energized conductors.
Among other methods one feasible and acceptable abatement method would be
to
train the employees in the hazards and protocols while working in trees and
around energized power lines as referred in the ANSI Z133.1-1994 for tree
care
operations.
