Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) Near Ball mill #1 - On or about 8/28/03, an employee attached two lift loops on a super sack container to the hoist lifting fixture and used a wood pallet on the raised forks of Yale fork lift truck #808 as a work platform. The pallet did not have a guardrail to protect the employee from falling, nor was the employee tied off. The pallet was not secured to the forks of the fork lift truck to provide stability, and to prevent it from moving on the forks or tilting from side to side. This employee was exposed to a fall of approximately 12 feet to the concrete floor below. Therefore, an employee was exposed to the recognized hazard associated with falls from an elevated unsecured work platform. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE METHOD TO CORRECT THIS HAZARD IS: 1. With the approval of the fork lift truck manufacturer, the use of a commercially manufactured safety platform or basket that is specifically designed for use on fork lifts and meets the specifications of the American National Standards Institute (ANSI)/ American Society of Mechanical Engineers (ASME) B56.1-1969 or current update to be used as stipulated in ASME B56.1-2000, paragraph 4.17, Elevating Personnel. 2. With the approval of the fork lift manufacturer, the in-house fabrication (certified by a professional engineer) of a proper safety work platform meeting the specifications of American National Institute (ANSI) American Society of Mechanical Engineers (ASME) B56.1-1969 or update to be used as stipulated in paragraph 4.17, Elevating Personnel REFERENCE: ASME B56.1-2000 Safety Standard For High Lift and Low Lift Trucks. NO ABATEMENT DOCUMENTATION REQUIRED
