Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: At the Comfort Inn construction site in Springdale, AR, employee(s) were exposed to crushing injuries while the GEHL Dynalift Rough Terrain Forklift was operated without the use of a seat belt to move materials being supplied to the site. Among other methods, one feasible and acceptable abatement method to correct this hazard is to establish a policy that requires: the use of seat belts, communication of the policy to employees, and enforcement of the use of seat belts.
