North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a)work site -- an employee was observed working and riding in the front bucket of a Case 580 backhoe. NOTE:Among other methods of abatement one feasible and acceptable method of abatement would be to train all employee to not work and ride in the bucket of a backhoe or any other type of equipment not designed for that purpose.
