Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to the hazards of falling, being crushed or being
caught between
while 1)  Being transported while sitting in the bucket of a NEW HOLLAND
LS170 Skid
Steer Loader; 2) being raised 8 feet plus into tree branches and  3) While
positioned under
the trees, being directed to cut branches off the trees while standing in
the bucket without
any fall protection.  CSHO observed violations on or about 9/9/2003.
ABATEMENT NOTES:   Among other methods, feasible methods to reduce this
hazard are to:
1)Follow Manufacturer's Operator's Warning Signs "CAUTION AVOID
INJURY" wherein it states the following:  KEEP CHILDREN AND
OTHERS AWAY;   NEVER CARRY RIDERS.
The Manufacturers Operators Manual (86585958) 7/99 under SAFETY
INFORMATION states on pages 0-5 & 0-6:
# 9) Do not allow passengers to ride on the skid steer at any time.
# 11) Do not allow anyone to operate the skid steer without proper
instruction
# 20)Wear approved safety hat when operating the machine and while in
any work area.
# 29)Do not allow anyone near the skid steer while the engine is running
and the skid steer is operational.
# 32DO NOT LIFT PERSONNEL OR ALLOW PERSONNEL TO
WORK WHILE STANDING IN THE BUCKET OR ON OTHER
ATTACHMENTS.  THIS IS NOT A MAN-LIFT.
2)Follow the National Safety Council's Safety Data Sheet 1-589-Reaf. 84
section 9 wherein it states the following:  No riders other than the
operator
should be allowed on the machine.  No loader should ever be used as a
work platform or staging.  Sudden movement in the hoisting mechanism,
caused by mechanical or hydraulic failure or human error, could result in
severe injuries.
